Binkx and its affiliates are offering a software platform for financial services (collectively referred to in the remainder of this document as “Services”) to help you take care of your financial needs. In order to do so, we as well as our subsidiaries, affiliates and third parties we work with in order to provide you with these Services sometimes need to collect certain information, including personal information, data about businesses and their customers (collectively referred to in the remainder of this document as “Data”). The Data allows us to provide you with Services, personalize your experience and improve customer service.
If we refer to “you” in the following paragraphs, it may be a visitor to the corporate site, an affiliate website, a user of our Services (collectively referred to in the remainder of this document as “User”) or a customer of a User. We’ll do our best to clarify who we are referring to at various points in the policy.
The Data we collect depends on how our Services are used. Sometimes we receive Data directly, such as when a new affiliate agreement is signed or a user account is created. Other times, we receive Data by recording interactions with our Services by, for example, using technologies like cookies and web beacons. We may also get Data from third parties we work with in order to provide you our Services.
The collection and use of Data from a variety of sources is essential to our ability to provide our Services – and to help keep our Services safe. As such data is critical in helping us and the third parties we work with to increase the safety of any transactions, reduce the risk of fraud, money laundering and other harmful activity.
2. Data We Collect
We may collect and store any information you provide us when you use the Binkx website, our app or any of our affiliate’s sites, including your contact information, such as name, phone, email other similar information. This is specifically required for large transactions and also applies to Data entered on a web form, customer, user, or affiliate application, as well as when you make updates to your account information, comment in community forums, chats, or dispute resolutions, or when you otherwise correspond with us regarding our Services.
3. How We Use Data
Our primary purpose in collecting Data is to provide you with a secure, smooth, efficient, and customized experience. In addition, we may use Data to: provide Services and customer support; send notices about your transactions; verify your identity, including during account creation and password reset processes; resolve disputes, collect fees and troubleshoot problems; manage risk, detect, prevent, and/or remediate fraud or other potentially prohibited or illegal activities; detect, prevent or remediate violations of policies or applicable user agreements; improve Services by customizing the user experience; measure the performance of Services and improve content and layout; manage and protect our information technology infrastructure; provide targeted marketing and advertising; provide service update notices and deliver promotional offers based on your communication preferences; contact you at any telephone number, by placing a voice call or through text (SMS) or email messaging, as authorized by our User Agreement; compare information for accuracy and verify it with third parties.
We may contact you via electronic means or by phone to notify you regarding your account, to troubleshoot problems with your account; to resolve a dispute; to collect fees or monies owed; to poll your opinions through surveys or questionnaires; to service your account.
Additionally, we may contact you to offer coupons, discounts and promotions, and inform you about added Services, updates to our Services etc. Finally, we may contact you as necessary to enforce our policies, applicable law, or any agreement we may have with you. To reach you as efficiently as possible, we may contact you via phone, and may use autodialed or prerecorded calls and text messages as described in our User Agreement. Where applicable and permitted by law, you may decline to receive certain communications.
4. How We Disclose Data
Binkx does not disclose any non-public personal information about you to any non-affiliated entity with the exceptions described below and otherwise permitted by law. We do not sell Data to marketers or unaffiliated third parties.
We may disclose Data collected to companies that assist us in providing Services you have requested or authorized and trusted third parties, including:
a. Binkx Affiliates: We share Data with entities that we control, are controlled by us, or are under our common control to provide our Services;
b. Binkx Service Providers: We share Data with service providers who help us provide Services such as money transactions and payment processing, data analysis, information technology and related infrastructure, customer service, email delivery etc.;
c. Binkx Users: We share Data with Users as necessary to provide Services. For example, we share Data with Users about purchases made by their Customers through Binkx or service providers assisting Binkx with financial transactions and payment processing services;
e. Safety, Legal Purposes and Law Enforcement: We use and disclose Data as we believe necessary:
(i) under applicable law, or payment method rules;
(ii) to enforce our terms and conditions;
(iii) to protect our rights, privacy, safety or property, and/or that of our affiliates, You or others; (iv) to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities, which may include authorities outside your country of residence.
We use reasonable organizational, technical and administrative measures to protect Data within our organization. Unfortunately, no Data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please contact us immediately.
When you access our website or use our Services, we (including companies and third party providers we work with) may place small data files on your computer or other devices you use to do so. These data files may be cookies, pixel tags, e-tags, "flash cookies," or other local storage provided by your browser or associated applications (collectively referred to in the remainder of this document as “Cookies”). We use these technologies to recognize you across multiple devices; customize Services, content, and advertising; measure promotional effectiveness; help ensure that your account security is not compromised; mitigate risk and prevent fraud; and to promote trust and safety across our sites and Services.
You are free to decline our Cookies if your browser or browser add-on permit to do so, unless our Cookies are required to prevent fraud or ensure the security of websites we control. However, declining our Cookies may interfere with your use of our website and Services.

You have choices regarding our use and disclosure of your Data:
a. Opting out of receiving electronic communications from us. If you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link included in such emails. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with our Services.
b. How you can access or change your Personal Information. If you like to review, correct, or update personal information that you have previously disclosed to us, you may do so by signing into Your Binkx account or by contacting us. If emailing us, please make clear in the email what personal information you would like to have changed. For your protection, we may only implement requests with respect to the Data associated with the particular email address that you used to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.
